The terms governing your use of the Aireforge website, software, and services.

These Terms of Service ("Terms") govern your access to and use of the Aireforge website, software, and services (collectively, the "Services") provided by Aireforge Limited ("Aireforge", "we", "us", "our"), a company registered in England and Wales. By accessing the Services, downloading our software, or completing a purchase, you agree to be bound by these Terms.

About Us

Aireforge Limited is a software company headquartered in Leeds, United Kingdom. We design and publish tools for SQL Server database performance, observability, and configuration management, including Aireforge Studio.

Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services. You are responsible for keeping your account credentials and licence keys confidential, and for all activity that occurs under your account.

Licence to Use the Software

Use of Aireforge software (including Aireforge Studio and the xOptics suite) is governed by our End-User Licence Agreement (EULA), which is presented at install or first use. The EULA describes the licence granted to you, permitted use, restrictions, intellectual property, support entitlements, warranty disclaimers and limitations of liability for the software itself. In the event of any conflict between these Terms and the EULA in respect of the software, the EULA prevails.

Editions, Trials and Free Versions

The software is made available in different editions, including free, trial, evaluation and paid versions. Free and trial editions are provided so that you can assess suitability, compatibility and performance in your own environment prior to purchase. Trials may be subject to time, feature, environment or usage limits, and we may modify or withdraw any free or trial edition at any time.

Pricing, Billing, and Merchant of Record

Purchases and subscriptions for Aireforge software are sold and processed by our merchant of record, Paddle.com Market Limited and its affiliates ("Paddle"). When you complete a purchase, you also enter into the Paddle Checkout Buyer Terms. Paddle handles payment, sales tax, invoicing, and refunds.

Prices are shown in the currency selected at checkout and may include applicable taxes. Subscriptions renew automatically at the end of each billing period unless cancelled in advance. You can manage or cancel a subscription via the Paddle buyer portal at paddle.net or by contacting us.

Refunds

Refunds are governed by our Refund Policy and the Paddle Checkout Buyer Terms. New purchases may be refunded within 14 days where the Software does not function substantially as described. Outside of that window, all sales are final, save where required by applicable law. Free and trial editions are provided so that you can assess the Software prior to purchase.

Acceptable Use

You agree not to use the Services to: (a) violate any law or regulation; (b) infringe the intellectual property or privacy rights of others; (c) attempt to gain unauthorised access to systems or data; (d) introduce malware or interfere with the integrity or performance of the Services; or (e) collect information about other users without their consent.

Intellectual Property

Aireforge, the Aireforge logo, and all software, content, and materials provided through the Services are owned by Aireforge Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the licence granted in these Terms, no rights are transferred to you.

Confidentiality and Data Protection

We process personal data in accordance with our Privacy Policy. You agree to keep any non-public information shared with you about Aireforge or our Services confidential.

Disclaimer of Warranties

The Services are provided "as is" and "as available". To the fullest extent permitted by law, Aireforge disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components.

Limitation of Liability

To the fullest extent permitted by law, Aireforge’s aggregate liability arising out of or in connection with these Terms or the Services shall not exceed the fees paid by you to Aireforge (or to Paddle on Aireforge’s behalf) in the twelve (12) months preceding the event giving rise to the claim. Aireforge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, revenue, or business opportunities. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold harmless Aireforge from any claims, damages, or expenses arising out of your use of the Services or your breach of these Terms.

Termination

We may suspend or terminate your access to the Services if you breach these Terms or fail to pay any applicable fees. Upon termination, your licence to use the software ends, and you must cease all use of the Services. Sections that by their nature should survive termination will continue to apply.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or legal requirements. We will post the updated Terms on this page and update the effective date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Services, except where mandatory consumer law in your country of residence requires otherwise.
